Buying and selling residential property

 

For many people, the acquisition and sale of real property can be the most important financial transactions that they engage in throughout their lives. The Torrens Title system in Australia has made the transfer of real property a more straightforward process compared to Old System Title. Where once detailed searches and constructing a 'Chain of Ownership' were necessary to prove good title to a property, the transfer process can still be a pitfall for the unwary.

 

Southern Legal is one of the earliest adopters of the PEXA (Property Exchange Australia) electronic conveyancing system introduced into New South Wales in 2015. Using this system, we can complete conveyancing tasks completed online and where settlements can take place seamlessly online.

 

The PEXA system, which is used by solicitors, property conveyancers and financial institutions, which may be entering or leaving the transaction as mortgagees, provides costs savings to clients as there is no need for any party to physically attend an exchange of contracts meeting or a final settlement.

 

For those selling property, we aim to have a marketing listing contract in the hands of your real estate agent within hours of us receiving your instructions and having ordered and received the required documents which form the contract. We then work closely with your Real Estate Agent once a purchaser is involved to exchange contracts as soon as possible and settle the sale with the minimum of delay. 

 

Our fixed professional fees for residential property conveyancing cover for all work, however, DO NOT INCLUDE costs and disbursements for items such as search fees, contract preparation and Local Council and Statutory Certificates, which we will charge AT COST. 
 

Providing 'Proof of Identity'  


As part of the PEXA electronic conveyancing system and to satisfy NSW Land and Property Information Verification of Identity (VOI) requirements, Southern Legal has entered into an arrangement with Australia Post to allow clients to attend any local post office that processes VOI applications.

 

The necessary form, which has a bar code unique to Southern Legal is available once instructions are received.
